Next Chapter Living – Privacy Policy

Next Chapter Living, LLC ("Next Chapter Living," "we," "us," or "our") operates an online platform that helps seniors and families discover senior living options and enables senior living businesses ("Communities" or "Facilities") to present their communities (the "Platform"). This Privacy Policy explains what information we collect, how we use and share it, and the choices and rights you have. By using the Platform, you agree to this Privacy Policy. If you do not agree, please do not use the Platform. When we make material changes, we will update the Effective Date and provide notice as described in Section 19.

1. How Our Model Works and How We Are Paid

We believe you should understand our business model before you share anything with us, so here it is in plain language.

The Platform is free for families. Participating Communities pay Next Chapter Living fees for our marketing, referral, and connection services, which is what allows the service to be free for you. We never charge families, and we never charge or accept a commission or placement fee tied to anyone's move-in.

When you submit an inquiry, tour request, message, or waitlist signup about a specific Community, you are using and directing us to intentionally disclose the information in your submission, including your name and contact details, to that one Community so it can respond to you. We share your inquiry only with the Community you selected. We do not send it to other communities, we do not add you to marketing lists for other facilities, and we will not share your inquiry with any additional community without your separate, express direction.

A Community that receives your inquiry is an independent business and handles your information under its own privacy practices, not ours. You can tell a Community to stop contacting you at any time, and you can also tell us, and we will promptly convey your instruction and stop further referral use of your information as described in Section 12.

2. Information We Collect

A. Information you provide.

  • Account and profile data, such as name, email address, phone number, and password.
  • Inquiry and interaction data, such as messages to Communities, tour requests, waitlist signups, search preferences, and any details you choose to include, which may include care-related information described in Section 3.
  • Reviews and other content you submit.
  • SMS opt-in data: if you consent to receive text messages, we collect your phone number, consent status, the date, time, and method of your opt-in.
  • Business listing data for Communities and their representatives, such as business name, address, services, photos, pricing, and availability.
  • Payment and billing information for businesses, processed by Stripe; Next Chapter Living does not store full card numbers.

B. Information collected automatically.

  • Usage, device, and network data, such as pages viewed, clicks, referring pages, IP address, browser type, operating system, and approximate location inferred from IP address.
  • Cookies and similar technologies used for essential operations, analytics, and, where enabled, advertising, as described in Section 7.
  • Call data for tracking numbers, described in Section 9.

C. Information from public and third-party sources.

  • Public regulatory data used to compile profiles of communities, drawn from state and federal sources such as licensing records, inspection and survey outcomes, citations, fines, and official ratings.
  • Neighborhood metrics, such as walkability and transit scores, crime metrics, and hospital distances, from third-party providers. These are provided as is under their providers' methodologies, and we do not guarantee their accuracy.

Categories under California law. The information above corresponds to these categories in Cal. Civ. Code 1798.140: identifiers; customer records; commercial information; internet or other electronic network activity; approximate geolocation; audio information (recorded calls); professional information (for business users); inferences; and, where you choose to share care-related details, sensitive personal information. We collect these categories from you, from your devices, from public sources, and from service providers, for the purposes in Section 5, and we have collected the same categories in the preceding 12 months.

3. Care-Related and Sensitive Information

Senior living research can involve health-adjacent information, such as the level of care someone needs. We treat this information with heightened care.

  • We collect only what is needed. We ask for care-related details only to the extent reasonably necessary to provide the service you request, such as matching you with appropriate care types or letting the Community you selected prepare to help you.
  • You choose what to share. Free-text fields are optional. Please do not include medical records or detailed health information; the Platform does not request or store personal health information as defined by HIPAA, and Next Chapter Living is not a HIPAA-covered entity.
  • Consent. Where we collect information that is treated as sensitive under applicable law, we do so with your consent, which you may withdraw as described in Section 12.
  • We do not sell sensitive information, and we do not use it for targeted advertising. Care-related details you share are used to provide the service you requested, including delivery to the single Community you selected, and for no other commercial purpose.

4. Information About Someone Else

Many people use the Platform on behalf of a parent, spouse, or other loved one, or as a professional assisting a client. If you submit information about another person, you represent that you are authorized to share it for the purpose of researching and contacting senior living options, for example as a family member, agent, or legal representative. We use information about a prospective resident only to provide the requested services, we treat their care-related details under Section 3, and the rights described in Section 12 may be exercised by an authorized agent or legal representative on a consumer's behalf, subject to reasonable verification.

5. How We Use Information

  • Operate, secure, and improve the Platform, including troubleshooting, analytics, and product development.
  • Deliver your inquiries, tour requests, messages, and waitlist signups to the Community you selected, and facilitate your communications with that Community.
  • Send text messages to users who opted in, as described in Section 8.
  • Create and display community profiles, including profiles compiled from public regulatory data.
  • Provide Communities with dashboards, analytics, and records regarding their own listings and the inquiries they receive.
  • Process business payments and billing through Stripe.
  • Verify service delivery, maintain records, and resolve billing questions with Communities, including through the call records described in Section 9.
  • Personalize content and measure the performance of the Platform.
  • Prevent fraud and abuse, enforce our Terms and Conditions, and comply with legal obligations.
  • Aggregate or de-identify data for analytics, research, and product development. We do not attempt to re-identify de-identified data.

6. How We Share Information

  • With the Community you selected. As described in Section 1, at your direction. Communities are independent controllers of the information they receive.
  • With service providers that support our operations, such as hosting, analytics, communications, customer support, call routing and recording, and payment processing, under contracts that limit their use of the information to providing services to us.
  • For legal reasons, to comply with law or legal process, to protect the rights, safety, or property of users, the public, or Next Chapter Living, or to detect and prevent fraud or abuse.
  • In a business transaction, such as a merger, acquisition, financing, or sale of assets, in which case this Policy will continue to apply to previously collected information.

About "selling" and "sharing." Some state laws define "sale" broadly to include disclosures of personal information for monetary or other valuable consideration, and define "sharing" to include disclosures for cross-context behavioral advertising. Our delivery of your inquiry to the single Community you selected is a disclosure made at your direction, which these laws exclude from the definition of a sale. We do not sell your personal information to data brokers, and we do not disclose your inquiry to any business you did not select. Separately, our use of cookies, analytics, and advertising technologies described in Section 7 may qualify as "sharing" or a "sale" under some state laws. You can opt out of that activity at any time through our "Your Privacy Choices" link or by using a recognized opt-out preference signal such as Global Privacy Control, and we honor those signals as valid opt-outs for your browser or device. We do not sell or share sensitive personal information, and we do not knowingly sell or share the personal information of anyone under 16.

SMS opt-in data. Mobile opt-in data and text messaging consent will not be shared with or sold to third parties or affiliates for marketing, promotional, or lead generation purposes. This information is used solely by Next Chapter Living to send the messages you opted in to receive. This restriction applies to all affiliates and subsidiaries.

7. Cookies, Analytics, and Advertising

We use cookies and similar technologies for essential site functions, to remember preferences, for analytics (including Google Analytics 4), and, where enabled, for advertising measurement. You can manage cookies through our cookie preferences tools and your browser settings. We honor Global Privacy Control and other recognized universal opt-out signals as a valid request to opt out of targeted advertising and of any "sale" or "sharing" for the browser or device sending the signal. Industry Do Not Track standards are not uniform, and we do not respond to DNT signals other than recognized opt-out preference signals. We configure our analytics and advertising tools to avoid transmitting care-related details, and we do not permit advertising partners to use Platform data to build profiles based on health information.

8. Text Messaging

If you opt in to receive text messages from Next Chapter Living: your consent is not a condition of using the Platform or of any purchase; message frequency varies based on your activity; message and data rates may apply; you can opt out at any time by replying STOP to any message, after which we will send one confirmation and stop; we honor standard revocation keywords and any reasonable opt-out method, within the timeframes required by law; reply HELP or contact support@nextchapterliving.com for assistance; and carriers are not liable for delayed or undelivered messages. See Section 6 for our commitment that mobile opt-in data is never shared with or sold to third parties or affiliates for marketing, promotional, or lead generation purposes.

9. Recorded Calls

Phone numbers displayed on Community profiles may be tracking numbers that connect you directly to the Community you are calling. Calls to these numbers may be recorded and monitored for quality assurance, service verification, record-keeping, and billing administration with the Community. A notice is played before recording begins, and continuing the call after the notice constitutes consent to recording. Recordings are retained for a limited period as described in Section 15, are accessible only for the purposes above, and are not sold or used for advertising.

10. Public Regulatory Data and Unclaimed Profiles

We compile profiles of communities that have not claimed a listing or joined the Platform from publicly available state and federal sources, such as licensing, inspection and survey outcomes, citations, fines, and official ratings. This data may lag official updates or contain source errors, and the issuing agencies' official records remain the authoritative source. If you believe an item is inaccurate, email support@nextchapterliving.com with the facility name, page link, the specific item, and a link to or copy of the official record. We will review and may update, annotate, or link to the official source; we do not guarantee a particular change or timeline. Publicly available government records may not constitute "personal information" under certain privacy laws.

11. Your Privacy Choices

You can access and update your account information at any time, opt out of marketing emails through the unsubscribe link in any message, opt out of text messages by replying STOP, manage cookies as described in Section 7, and tell us to stop referral use of your information as described in Sections 1 and 12.

12. Your Privacy Rights

We extend the following rights to all U.S. residents, regardless of state, and we honor them within the timeframes required by the law of your state (typically 45 days, with permitted extensions):

  • Access and portability. Confirm whether we process your personal information and obtain a copy in a usable format.
  • Correction. Correct inaccurate personal information.
  • Deletion. Delete personal information we hold about you, subject to legal retention needs.
  • Opt-out of targeted advertising and of any sale or sharing, including via Global Privacy Control.
  • Limit sensitive information. We already limit sensitive information to the service you requested, and we do not sell it or use it for targeted advertising.
  • List of recipients. On request, we will provide the list of Communities that received your information from us. For residents of states that grant a right to the identity of third-party recipients, including Oregon and Minnesota, we honor that right as written.
  • Profiling. We do not make automated decisions about you that produce legal or similarly significant effects. Minnesota residents additionally have the right to question the result of any such profiling if we ever conduct it, to be told why the decision was reached, and to have human review.
  • Non-discrimination. We will not discriminate against you for exercising your rights.
  • Appeals. If we decline a request, you may appeal by replying with "Appeal of Privacy Request." We will respond within the period required by your state's law. If your appeal is denied, you may contact your state Attorney General; Minnesota residents may contact the Minnesota Attorney General.

How to exercise rights. Email support@nextchapterliving.com with your name, state of residence, and the request type, or use any rights form we provide on the Platform. We will verify your identity using reasonable methods that do not require you to create an account, and an authorized agent or legal representative may submit requests on your behalf with appropriate authorization.

California. California residents have the rights described above under the CCPA, including the rights to know, delete, correct, opt out of sale or sharing, and limit use of sensitive personal information. Section 2 describes the categories collected, our sources, and purposes; Section 6 describes the categories disclosed and the recipients, our position on "sale" and "sharing," and our treatment of opt-out preference signals; Section 15 describes retention. We do not use or disclose sensitive personal information for purposes beyond those permitted by the CCPA regulations, and California's "Limit the Use of My Sensitive Personal Information" right is honored by default.

Nevada. Nevada residents may direct us not to sell covered information by emailing support@nextchapterliving.com with "Nevada Opt-Out" in the subject line.

Other states. Residents of states with comprehensive privacy laws, including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Kentucky, Indiana, Tennessee, Rhode Island, Minnesota, and Maryland, hold the rights listed above as provided by their state's law, and we will honor rights under new state laws as they take effect.

13. Senior Consumer Protections in Certain States

Some states grant specific protections to consumers who use services that are paid by senior living communities in connection with referrals, including Washington, Oregon, Colorado, Arizona, Texas, Maryland, and Georgia. Regardless of your state, we honor the following: we share your information only with the Community you selected, and never with an additional community without your fresh, express direction; you may stop our services and further referral use of your personal information at any time, without penalty, by emailing support@nextchapterliving.com, and we will promptly notify any Community that received your information from us; we do not refer consumers to any facility that Next Chapter Living or its owners own or hold a financial interest in; and we retain referral records for at least three years where state law requires. If your state's law requires additional disclosures or acknowledgments, you will receive them at or before the time of your referral, and nothing in this Policy limits any non-waivable right your state grants you.

14. Washington and Nevada Consumer Health Data

For Washington and Nevada residents, care-related information described in Section 3 may constitute "consumer health data" under the Washington My Health My Data Act or Nevada SB 370. We collect such data only with your consent and only to provide the services you request; we share it only with the Community you selected, at your direction; we do not sell consumer health data; and you have the right to access it, to withdraw consent, to have it deleted, and to receive a list of the third parties with which it was shared. To exercise these rights, email support@nextchapterliving.com. If we deny a request, you may appeal as described in Section 12, and Washington residents may contact the Washington Attorney General.

15. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, using these criteria: account data, while your account is active and for a limited period thereafter; inquiry, message, and referral records, for the life of the inquiry and for at least three years where state referral laws require, and otherwise typically 24 months after last activity; call recordings, for up to 12 months; SMS consent records, for the duration of your participation and a reasonable period thereafter to demonstrate compliance; business billing records, for up to 7 years for tax, audit, and legal purposes; analytics data, per the retention settings of our analytics tools (user-level data 2 to 14 months); and de-identified or aggregate information, which we may retain indefinitely. When retention ends, we delete or de-identify the information.

16. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including encryption in transit, access controls, and periodic security reviews. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your interaction with us is no longer secure, contact support@nextchapterliving.com immediately. If a breach affecting your personal information occurs, we will notify you and regulators as required by applicable law.

17. Children and Minors

The Platform is intended for adults and is not directed to children. We do not knowingly collect personal information from anyone under 18, and we do not knowingly sell or share the personal information of minors or use it for targeted advertising. If you believe a minor has provided us personal information, contact support@nextchapterliving.com and we will delete it promptly.

18. Payments, Third Parties, and International Users

Business payments are processed by Stripe, which collects and processes payment data under its own privacy policy. The Platform may link to third-party sites and services; we are not responsible for their privacy practices, and we encourage you to review their policies. The Platform is intended for users in the United States; if you access it from elsewhere, you understand that your information will be transferred to and processed in the United States.

19. Changes to This Policy

We may update this Policy from time to time. We will post changes with a new Effective Date, and for material changes we will provide reasonable advance notice, such as by email to account holders or a prominent Platform notice, and, where required by law, an opportunity to withdraw consent for materially new uses of previously collected information.
